Terms of Service

1. Acceptance of Terms

By using Syntharé, you agree to comply with these Terms and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and the operator of Syntharé™.

2. Description of Service

Syntharé™ is an AI-powered marketing intelligence platform providing:

• Permanent brand memory
• Encrypted identity storage
• AI-generated campaigns, ads, landing pages, content, and image prompts
• Credit-based usage system
• Strategy engines, personas, and multi-model outputs

Syntharé is constantly updated and may change over time to improve service quality and features.

Syntharé™ includes encrypted brand memory, identity storage, and AI-generated marketing tools as part of its core service.

3. Eligibility

You must be at least 16 years old to use the platform.

If you are using Syntharé on behalf of a company, you represent that you have authority to bind that company to these Terms.

4. Account Registration & Security

You must provide accurate information and maintain the security of your account.

You are responsible for:

• All activity under your account
• Keeping your login credentials confidential
• Not sharing accounts with others

We reserve the right to suspend accounts with suspicious or harmful activity.

6. AI Output Disclaimer

Syntharé uses multiple AI providers (OpenAI, Anthropic, Google, etc.) to generate content.

You acknowledge:

• AI may produce incorrect, imperfect, or unexpected content
• You are responsible for reviewing outputs before publishing
• Syntharé is not liable for business decisions made based on AI output
• You retain full responsibility for compliance with advertising laws, platform rules, and factual accuracy

7. User Responsibilities

You agree NOT to:

• Use Syntharé to generate misleading, harmful, discriminatory, or illegal content
• Reverse-engineer or attempt to extract system prompts, architecture, or logic
• Abuse or overload the platform
• Violate third-party intellectual property rights
• Upload malicious content, harmful code, or unsafe materials

We may suspend or terminate accounts that violate these obligations without prior notice.

8. Credits & Billing

Syntharé operates on a subscription + credits model.

8.1 Subscription Billing

• Subscriptions renew automatically
• Prices are listed in USD
• Billing is handled securely through Stripe
• You can cancel anytime; access continues until the end of the billing cycle
• No partial refunds for unused subscription time

8.2 Credits

• Credits are deducted when you generate campaigns, landing pages, images, platform formats, etc.
• Credit costs are displayed on the Pricing page
• Credits included in your monthly plan reset monthly
• Purchased extra credits do not expire

9. Intellectual Property Rights

9.1 Your Rights

Any content you upload (BrandDNA, EmotionalDNA, product descriptions) remains yours.

Outputs generated by Syntharé (campaigns, ads, landing pages) are yours to use commercially.

9.2 Our Rights

The Syntharé brand memory engine, architecture, prompts, models, UI, and backend logic remain exclusive property of Syntharé™ and its creator.

You may not:

• Copy the system
• Create competing derivative products
• Extract proprietary behavior or strategy layers

10. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You misuse AI
• You engage in fraudulent or abusive activity

You may terminate your account at any time through account settings or by contacting support.

Upon termination, your encrypted brand memory is deleted within 30 days.

11. Limitation of Liability

To the maximum extent permitted by law:

• Syntharé is provided "as is" without warranties
• Syntharé is not liable for indirect, incidental, or consequential damages
• Syntharé's maximum liability is limited to the amount you paid in the last 30 days
• AI output cannot be guaranteed to be error-free

12. No Warranty

We do not guarantee:

• That AI output will be accurate
• That the system will be uninterrupted
• That results will meet your expectations

However, we will do everything reasonably possible to ensure high-quality performance and continuous improvement of our services.

13. Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles.

Any disputes arising from these Terms shall be resolved in the courts of Malaysia.

14. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.

Significant changes will be communicated via email or through in-app notifications.
